Mr. Michael Eskander is a 1987 graduate of the University of Ein Shams, College of Law in Cairo, Egypt. Mr. Eskander also is a 1995 graduate of the University of Iowa, College of Law.

He is admitted to practice law in Egypt, Iowa and Arizona. Trained primarily as a litigator, he joined the Law Firm of Eskander, Eskander and Riad, and practiced in the field of criminal defense, immigration and personal injury. Counsel affiliated with the firm handles family law matters.

Mr. Eskander is skilled in the uncompromising and aggressive representation of criminal and DUI cases throughout the entire State of Arizona including all federal, county and city courts. DUI or Driving Under the Influence of Alcohol / Drugs

YOU ONLY HAVE 15 DAYS TO REQUEST A MVD HEARING AFTER YOUR ARREST IN ORDER TO PREVENT SUSPENSION OF YOUR DRIVING LICENSE!

If you have been arrested for a DUI, you do not need to plead guilty. There are several defenses that may be available to you, here are a few:
  • The arresting officer did not have probable cause to pull you over DUI
  • You were denied your right to an independent blood and/or breath test
  • The chemical test results were inaccurate
  • You were questioned in violation of your miranda rights
  • You requested but were denied the right to see the credentials of the person who drew your blood
  • You requested but were denied the right to an independent test
  • You have been denied your right to a speedy trial
  • You were denied access to counsel or contact an attorney while in custody
  • Failure of law enforcement to observe proper chain of custody for any evidence seized.
  • The officer did not follow the proper procedures when administering the alcohol tests
  • The officer did not follow the proper procedures when administering the field sobriety tests
  • Your blood alcohol level was lower when driving than when tested
  • The breath tests results were too high because there was still alcohol in your mouth

Arizona DUI laws provide for harsh and severe punishments. Thus, I fight aggressively for your rights in order to reach a favorable outcome for your case. This can be through negotiating a lesser charge, complete dismissal or even acquittal after trial. I will never allow my client to plead guilty to a DUI without a detailed and comprehensive investigation of the matter.

Driving under the influence can be charged as either a misdemeanor or a felony, depending upon your record, age of vehicle occupants, or whether there were serious injuries. If you are arrested for a DUI, you have the right to refuse to do the field sobriety tests and the portable breath test that the police want you to take in their field investigation. However, Arizona law requires that you take a blood or breath test after you are arrested and brought down to the police station.

Criminal Law

Mr. Eskander developed numerous pre-trial strategies allowing for a favorable resolution of most criminal cases without the need to go to trial. He is talented in challenging and hindering unconstitutional police actions; such as coercive police interrogations, disrespect of suspect’s procedural safeguards, obtaining Miranda waiver and false confessions from innocent people, and police use of impermissible techniques to break ones physical and mental strength. Mr. Eskander places clients’ best interest as the ultimate goal of representation and thus believes that challenging prosecutors is only one of the tools available. His approach in dealing with the Maricopa County Attorney's Office recent and ever increasing stringent policies prevailed when he obtained several mitigated and super mitigated sentences during the last few years.

Dismissal of charges, acquittals and not guilty verdicts following trial on the merits are quite common in Mr. Eskander’s practice

State v. Soza, charged with aggravated assault, assault and disorderly conduct, the jury returned a NOT GUILTY verdict. When questioned as to factors leading them to that decision, members of the jury referred to Mr. Eskander’s animated abilities to assure them of Mr. Soza's innocence.

State v. Miller, was found NOT GUILTY after being wrongfully accused of Burglary in the third degree

State v. Begaye, who was found NOT GUILTY of aggravated assault with a deadly weapon, a dangerous felony (where if found guilty after trial, prison would have been mandatory)

State v. Dean, who was found NOT GUILTY of possession of dangerous drugs and drug paraphernalia and theft

State v. Prince, who was found NOT GUILTY of importation and transportation of narcotic drugs for sale

State v. Al-Amiri, who was found NOT GUILTY of sexual assault (rape), but guilty on the aggravated assault and sentenced to probation and 4 months jail (state's offer before trial was prison for a term of 15 to 20)

Goff v. Burton, for prisoner's civil rights violations where Michael drafted the final brief submitted to the U.S. 8th Circuit Court which led to an award in excess of $100,000.00

State v. Sheats, resulting in dismissal of prosecution with prejudice

State v. Tapia, who was found NOT GUILTY of robbery, possession of dangerous drugs and aggravated assault charges.

Mr. Eskander also handled cases of 2nd degree murder, sexual conduct with a minor (where a possible punishment is 35 years to natural life), kidnapping, and acquisition of prescription medication by fraud.
